Connecticut Trial Firm was recently awarded a $2.3 million jury verdict on behalf of our client who was seriously injured in a rear-end motor vehicle accident. We would like to congratulate Attorney Alexa Mahony and Partner Trial Attorney Andrew Garza for all their hard work, as well as walk you through how the trial played out.
Case Background
The case started when our team received a call in which we found out our client was injured and hospitalized after a rear-end car accident and later needed surgery. This was an accident that would affect our client in the long run. The first step we took was to start an investigation, which consisted of obtaining statements, sending out preservation letters, and truly understanding what type of case our client was dealing with.
The Process
We obtained firsthand information from the client, the client’s family, and doctors. We were then able to read through medical records and discuss with experts in various fields who were able to give insight and help our team better understand the severity of the injuries our client was facing.
Taken to Court
After the investigation, our firm determined that our client was severely injured and the other party was at fault. Given the amount of insurance in question and the types of injuries, the case was unlikely to settle pre-suit for a fair value. These types of cases require litigation. Insurance companies want to profit as much as possible, which often means that they lowball injured people in hopes that they will not take the case to trial. However, our team is not afraid of going to court to get our clients what they deserve.
We started the litigation process by filing a lawsuit and taking several depositions. These depositions were used to prove our claim through a carefully compiled detailed case. The offers during the lawsuit were unacceptable to offer our client; this was carefully evaluated through focus groups. The insurance company failed to do the right thing—so we took them to trial.
The Verdict
The insurance company refused the statements made in court, but the jury awarded a $2.3 million verdict and found common law recklessness, which further bumps the verdict amount. We were overjoyed that we were able to get our client the compensation that was rightfully theirs.
Tenacious trial attorneys will get the results that clients need, different from what an insurance company offers. If you were in a car accident or suffered any other kind of injury at the hands of someone else, do not settle for less than you deserve.
