Lucenti v. Laviero

Plaintiff suffered injuries while at work as a result of a machine which had been improperly repaired. The plaintiff claimed that because the defendant was substantially certain that an injury would occur, the exclusivity provision of the Workers’ Comp. Act did not apply and he was therefore entitle to civil damages for his injuries. The court ruled in favor of the defendant.
